Update 3/13/23:
Chill The Build Files Lawsuit to Stop HighRose/Verandas Project
Chill The Build filed a Writ of Mandamus on February 21, and an amendment on February 24th. The City of MB was then served on March 6. The City has 20 days to respond with a notice of a settlement conference date. In a nutshell, this legal document forces the hand of the city once and for all on the CEQA review requirements we believe are necessary given the property in question resides feet away from an active polluting refinery that’s been around for over 100 years. Regardless of the outcome, be assured we are continually strategizing our next legal move. Like many of you, we also believe it is preposterous for anyone to actually believe that affordable housing, or any new housing, should be placed adjacent to an active polluting refinery given the history of refineries in our state. Everyone knows this, but it is one’s choice to either put your head in the sand and ignore it, or do something about it. We chose to acknowledge this fact and fight to do the right thing.
